If someone dies because of another person’s negligence, the surviving family members may sue for compensation in what is called a wrongful death lawsuit. Wrongful death lawyers and judges conduct the case in the same manner as a personal injury lawsuit, meaning that a wrongful death trial must also show that misconduct of some kind resulted in the death. There is a difference, however, between these lawsuits.
For personal injury cases, the person who is injured mainly wants compensation for lost wages and medical costs. In a wrongful death suit, the surviving family members want compensation that would have been paid had the deceased lived to recover damages.
